1. Liability

THE COMPANY reserves the right to unilaterally modify, without prior notice or communication to the USER and/or VISITOR, these Terms and Conditions, the design, presentation or configuration of the site, the services offered, and the requirements for registering on or using the site, without this giving rise to any right to claim or compensation in favor of the USER and/or VISITOR. Use of the services and/or digital tools available on the site will require the USER and/or VISITOR to accept terms and conditions that supplement the provisions contained herein, insofar as they do not conflict with them.

THE COMPANY shall not be liable for the existence, updating, accuracy, privacy, operation, modifications, content, offers or legality of third-party sites linked through this website. THE COMPANY shall not be liable for transactions carried out between the USER and/or VISITOR and the sites linked from this site. THE COMPANY reserves the right to extract and edit, in whole or in part, any message or material signed or submitted by the USER and/or VISITOR. Likewise, the USER and/or VISITOR grants THE COMPANY permission to use any information, suggestion, idea, drawing or concept submitted, so that THE COMPANY may use it to obtain statistical information to improve the service, without any right to compensation in favor of the USER and/or VISITOR.

The USER and/or VISITOR undertakes to use the Site in accordance with these Terms and Conditions, in a diligent, proper and lawful manner, and in accordance with morality and good customs. The USER and/or VISITOR shall be liable for any damages of any nature that THE COMPANY may suffer, directly or indirectly, as a result of the breach of any of the obligations arising from these Terms and Conditions.

THE COMPANY may temporarily suspend or discontinue publication of the site without prior notice and at any time, without this giving rise to any right to compensation in favor of the USER and/or VISITOR. The USER and/or VISITOR acknowledges and accepts that use of this site is at their own sole and exclusive risk. The USER and/or VISITOR acknowledges and accepts that neither THE COMPANY nor the directors, employees or representatives of any of them are liable for damages arising from or resulting from the use of this site, including any error, omission, interruption, failure, deletion of files or emails, defects, viruses, and/or delays in operation or transmission, and/or of any other kind. The site may be used by the USER and/or VISITOR entirely freely and free of charge.

This site makes available to you technical linking devices (such as, among others, links, banners and buttons), directories and search tools that allow you to access web pages belonging to third parties (hereinafter the “LINKED SITES”). The placement of these links on THE COMPANY's pages is solely intended to make it easier for the USER and/or VISITOR to search for and access the information available on the linked sites on the Internet, and does not imply that there is any kind of relationship or association between THE COMPANY, its subsidiaries or affiliates and the operators of the linked sites.

THE COMPANY does not control or endorse as its own the services, information, data, files, products or any other kind of material available on the linked sites. Therefore, the USER and/or VISITOR must exercise the utmost caution in assessing and using the services, information, data, files, products and any other kind of material available on the linked sites. THE COMPANY does not guarantee or assume any liability for damages of any nature that may be caused by:

  1. The operation, availability, accessibility or continuity of linked sites.
  2. The maintenance of the services, information, data, files, products and any other kind of material available on the linked sites.
  3. The obligations and offers existing on the linked sites.

    4. 2.1. Quality

    By using this site, the USER and/or VISITOR acknowledges and accepts that THE COMPANY does not control or guarantee the absence of viruses in the content of the linked sites, nor the absence of other elements that could cause alterations to their computer systems or to the electronic documents and files stored in the USER's computer files.

    2.2. Intellectual Property

    By using this site, the USER and/or VISITOR acknowledges and accepts that THE COMPANY is excluded from any liability that may arise from the unauthorized use of trademarks or other intellectual property rights of third parties or contained in the linked sites. Likewise, any references made on this site to any product, service, process, linked site, hypertext or any other information using trademarks, distinctive signs or domains, the trade name or the name of the manufacturer, supplier, etc., owned by third parties, shall at no time constitute or imply any endorsement or recommendation by THE COMPANY. And under no circumstances shall THE COMPANY claim ownership of or responsibility for them.

    3. Privacy Policy

    Use of and access to THE COMPANY's website shall be deemed acceptance by the USER and/or VISITOR of the terms of this Privacy Policy. The personal data that the USER and/or VISITOR freely and voluntarily provides to THE COMPANY, such as names, email address, national ID (DNI), telephone number and/or file number, and/or any other data voluntarily supplied to THE COMPANY when necessary to provide a specific service, is included in automated files and processed under strict confidentiality and data protection standards. The USER and/or VISITOR may provide information regarding their tastes, evaluations and preferences. THE COMPANY will use such information to create advertising and/or improve the service provided. Notwithstanding the foregoing, and in compliance with applicable laws, THE COMPANY cooperates with national, provincial, municipal and international government authorities in any investigation relating to content, whether personal or private, transmitted to THE COMPANY through this Site.

    4. Termination of Access

    5. System or Database Violations

    Any action or use of devices, software or other instruments intended to interfere with the activities and operations of THE COMPANY, or with THE COMPANY's offers, descriptions, accounts or databases, is unlawful. Any intrusion, attempt or activity that violates or is contrary to the laws on intellectual property rights or system security, and/or the prohibitions set forth in this document, shall render the person responsible liable to the relevant legal actions and to the penalties provided for in this agreement.

    6. Jurisdiction

    These Terms and Conditions shall be governed by and construed in accordance with the laws of the Argentine Republic. The USER and/or VISITOR agrees that any legal action or proceeding between THE COMPANY and them, for any purpose relating to these Terms and Conditions, shall be brought exclusively before the Ordinary Civil Courts of the province of Mendoza.

    You hereby acknowledge that you have been duly informed of the purpose for which your personal data has been collected and who may receive it, as well as your right to access it and to request its rectification and/or deletion, all in accordance with National Law of the Argentine Republic No. 25326 (Personal Data Protection) and its Regulatory Decree No. 1558/01.
